I think the whole "banned" thing is marketing. I loved the commercial. I mean, even one of the biggest selling RPGs on the system (Mass Effect) has that whole over the shoulder shooter vibe ;) (Cool game, btw.) Of course, I realized the other day that I own more Xbox Live Arcade games then actual physical games..so maybe that is someting they should put into future advertisment.
